By participating in the AccessFares Fiji Challenge (“Promotion”), all participants (“Participants”) acknowledge and agree to the following liability and publicity provisions:

1. Release of Liability

Participants expressly acknowledge that their participation in the Promotion is voluntary and at their own risk. By entering the Promotion, Participants hereby release, discharge, and hold harmless AccessFares, Fiji Airways, their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and each of their respective officers, directors, employees, agents, and representatives (collectively, the “Released Parties”) from and against any and all liability, claims, damages, or causes of action of any kind whatsoever, including but not limited to personal injury, property damage, death, loss, or expense, arising out of or related to:
 

• Participation in the Promotion

• Acceptance, receipt, possession, use, or misuse of any prize

• Travel or activities related to prize usage

• Any error, delay, interruption, or technical malfunction related to contest administration or flight booking
   

AccessFares makes no warranties, express or implied, regarding the Promotion or any prize provided in connection therewith. Prizes are provided “as is” without any warranty of any kind.

2. Indemnification

Participants agree to indemnify and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to their participation in the Promotion or violation of these terms.

3. Assumption of Risk

Participants assume all risks associated with travel, including but not limited to airline delays, cancellations, acts of nature, health issues, injury, or loss of personal property. Participants acknowledge that AccessFares and its partners are not responsible for airline policies, seat availability, blackout dates, or other restrictions imposed by Fiji Airways or third parties.

4. Publicity Release

Except where prohibited by law, each Participant agrees that, if selected as a winner, AccessFares and its agents shall have the right to use the Participant’s name, company name, photograph, likeness, city and state of residence, and any statements made by the Participant regarding the Promotion or prize in marketing, advertising, publicity, and promotional materials in any media worldwide, in perpetuity, without notice, review, approval, or additional compensation.

5. Consent and Acknowledgment

By participating in the Promotion, Participants affirm that they have read, understood, and voluntarily accept the terms of this Liability and Publicity Waiver. Participants further acknowledge that they have had the opportunity to consult with independent legal counsel regarding these terms prior to participation.
